Lalu Prasad Yadav, the RJD supremo and former C union minister, has been granted bail in the fodder scam case by the Supreme Court, which accepted an argument today that other accused in the case had also secured bail. The 66-year-old Rashtriya Janata Dal leader was jailed in October after he was convicted and sentenced to five years in jail for allegedly embezzling government funds while he was Bihar Chief Minister. "Similar accused have already been granted bail and Lalu Prasad was in jail for a year out of his five-year sentence," the court said today. The CBI had opposed his bail, telling the Chief Justice of India, P Sathasivam, that Mr Prasad "should not run away."

The bench headed by the Chief Justice had issued notice to the CBI after senior lawyer Ram Jethmalani told the court that barring Lalu Prasad, no other convict in the case has been refused bail. Mr Jethmalani said 44 people were convicted in the case, of whom 37 have already been granted bail and bail applications of six others are under consideration. The court asked the Jharkhand High Court, which said Mr Prasad's bail plea was pending; the court was still hearing appeals of 1999-2000.
